« Im Rahmen der Gemeinsamen Aussen- und Sicherheitspolitik besteht seit Inkrafttreten des Vertrags von Amsterdam (1999) die Möglichkeit der konstruktiven Enthaltung. Demnach kann jeder EU-Mitgliedstaat in einer förmlichen Erklärung festhalten, dass er sich im Ministerrat bei einer bestimmten Entscheidung seiner Stimme enthält (Art. 31 Abs. 1 UAbs. 2 EUV). Dieser Mitgliedstaat ist dann nicht verpflichtet, den Beschluss durchzuführen, akzeptiert jedoch, dass der von den anderen EU-Mitgliedern verabschiedete Beschluss für die EU bindend ist; er darf darüber hinaus die anderen EU-Staaten nicht daran hindern, die vereinbarten Ziele zu erreichen. »
