Infraction contre l'État et la défense nationale commise par une personne qui fonde un groupement qui vise ou dont les activités consistent à accomplir la haute trahison, l'atteinte à l'indépendance de la Confédération, des entreprises et menées de l'étranger contre la sécurité de la Suisse, des actes exécutés sans droit pour un État étranger, le service de renseignements politiques, économiques ou militaires, des atteintes à l'ordre constitutionnel ou la propagande subversive, qui y adhère, s'associe à ses menées, provoque sa fondation ou se conforme à ses instructions.
