anglais
  • court of construction (correct)

CONT: In construing a will, the aim of the Court of construction should be to determine the precise disposition of the property intended by the testator. The Court should attempt to ascertain, if possible, the testator's actual or subjective intent as opposed to an objective intent presumed by law. The Court should not be concerned with a hypothetical or reasonableman standard, but with the meaning that the particular testator attached to the words used in his will.
